254 Charles County Court Proceedings, 1668—1670. Liber D sometimes watched to see that none came to discover them the next was Melchor Kirkman Jerard FitsGerard Thomas Skiff John Smith Christor Enibuson Derick Enibuson Andreas Peterson and Jasper [p. 149] Elieson and further this Deponent saith that these servants had told him that they had brought home and eate with out the knowledge or permission of their said Master one hogg and one shoate but what marke they had this Deponent knoweth not and further can not say Tho: Miller Examined and Sworne before his marke me this Day the second of February Anno Domini 1668 Jerome White [p. 150] Daniell Johnson Plt came to prosecute the suite by him Com- menced agt John Barnes John Barnes Came also & appeared to defd the suite Commenced agt him by Daniell Johnson Whereupon the plts Declaracon was reade vizt [blank space follows] The Defd saies he is not guilty of tresspass specified in the Declara- con & of this he puts himself on the Country & the sd Plt likewise Whereupon there was a jury impanelled who retired Mary Wheeler aged forty years sworne & saith tht tht yeare my husband went the march my husband owed Daniell Johnson an hhd of tobacco & I was weeding of a tobacco bed wn Daniell Johnson came & asked me if there was any tobaco ready & I told him I would give him notice wn there was any ready & I follow'd the Cart as fast as I could & I meett Mr Barns who sd he had order from Daniell Johnson to rece an hhd of tob & he recd & Marked & weighed Itt & further saith not [p. 151] John Paine aged thirty four years sworne & saith That Mrs Wheeler came to my house to demand an hhd of tob for Daniell Johnson & it came onweigh'd or marked in a Cart & Mr Barns sd he had an ordr for it & he weigh'd it & gave a receipt for itt & Mr Barns said after he had weighd itt Neighbor Paine will you let me have rome for it till I can send for it & there came Daniell Johnson in a short time after & scartched Barns mark out & I was comeing from the water side & I mett him & he told me tht he had put out that mark & marked it wth his owne wth a Vengence & he bid me not it to Barnes for he owed him not soe much & tht he ordered it for another Marchant & Mr Barns came wn I was not att home & tooke it away & I went after him to Wm Simpsons & told him Mr Johnson ordered me to keep it & I tooke my Canow & went & ac- quainted Mr Johnson wth itt & he asked me where the Constable did live & I told him I knew not & further saith not.
