          248 Charles County Court Proceedings, 1668—16 70.
          Liber D            Richd Dodd Plt  James Hayes Deft
                And whereupon the sd Richd complaineth agt the sd James for tht
               whereas the sd James in the month of Apr in the xxxvii yeare of
               Caecilius 1668 & att severall daies & tiths since had & recd from the
               sd Richd divers goods & Accomodacons & Attendance amteing to
               660 lb of tob in Consideracon whereof the sd Jams did Assume upon
               himself & to the sd Richd did pmise tht he the sd James the sd
               sume of 660 lb of tob to him the sd Richd wn thereunto required
               would well & truly satisfy & pay Never the less the sd James his
               sd promise & Assumpcon little regarding but deviseing & fraudulenty
               intending him the sd Richd of the sd sume of 660 lb to deceive the
               sd sume of 660th of tob hath not pd according to his promise to
               the sd Rich” on tht behalf e made but doth altogether refuse to pay the
               same to his the sd Richds great Damage whereupon he saith he is
               damnifled to the Valew of 900 lb of tob & hereupon he bringeth
               his suite.

                Whereupon the Deft replied tht he had noe Attendance att the
               plts house & hereupon the plt requested tht Edwd Maddock might
               have his oath given him who was sworne
                Edwd Maddock aged 22 or 23 years sworne & saith tht to his
               knowledge the Deft was very dangerously att the plts house a fourte-
               night or three weeks & tht the plt had a great deale of trouble wth the
               Deft dureing tht time
                Jno Kimbrow aged 29 years or therabouts sworne & saith tht one
               day sn he was goeing to work att Robt Clearks he called att Mr
               Lomax his house where he se James Hayes & he sd James yo11 are
               very ill & he answered I wish tht Goody Dodd or some would come
               to him & I answered I would Indeavoure to get her to come & wthin
               two or three daies he came to Rjchd Dodds him self but further
               saith not
                whereupon the plt & Mary his Wife pduced an Acct wch the Deft
               denied' but never the less he told the Court if the Plt & his Wife
               would sweare to the ensueing Acct he would pay them the Acct
               whereupon they were sworne & say tht it is a true acct & tht they
               never reed any satisfacon

               It for two gallans of Brandy            100
               It for washing & make ing of Linen      160

                Whereupon It was ordered tht the deft pay the plt 660 lb of tob

                The plt alsoe preferred this bill of Costs wch was allowed him
                     Attendance 3 daies           90
