Charles County Court Proceedings, 1668—16 70. 241 five hundred pounds of tobaccoe & thereupon he bringeth his Suite Liber D And whithall preferred his accot amounting to the Said Sume of [p. 125] 327th of Ton: To which the Said John replyed that he was overcharged in the Said accot & put the plt to the proofe thereof & farther that he had payed to the Sheriff for the use of the plt two hundred fifty five pounds of Tob: which he did Judge to be all his Just due debt to the Sd plt: whereupon Ralph Coates being Sworne & Examined on the behalf e of the plt Saith That he did delliver to the Defendt the particulars meconed in the Said accot Whereupon after abatemt made in open Court by the plt the Court gave Judgement against the deft for the Sume of twenty two pounds of tobaccoe with Costs of Suite & the plt was by the Court allowed for his Costs & attendance 90th of tobaccoe. Edward Maddock Plt came & appeared to prosecute the suite by him Commenced agt James Lee for eight hundred fifty eight pounds of tob James Lee Deft came likewise & appeared to answer & defend the suite comenced agt him by Edwd Maddock afgd Whereupon the plts Declaracon was read in Court to the effect vizt The sd Edwd Complaineth agt the sd James by a bill under his hand & seale beareing date the twenty sixth day of June 1669 in the xxxviii yeare of the Dominion of Caecilius standeth indebt'd unto him the sd Edward in the sume of eight hundred fifty eight pounds of tobaccoe & being soe indebted he the sd James the sd sume of eight hundred fifty & eight of tobaccoe on him self did then assume & to the sd Edward well & truly to pay did faithfully promise Never- theless the sd James his promise & Assumpcon little regarding but deviseing & fraudulently intending him the sd Edwd of the sd sume of eight hundred & fifty eight pounds of tob to deceive the sd sume of eight hundred fifty eight pounds of tob to the sd Edwd hath not satisfied but doth altogether refuse for to pay the same to the great damage of him the sd Edward whereupon he saith he hath loss to the Value of one thousand two hundred pounds of tob & thereupon he bringeth his suite. & wthall he produced his bill to wch Richd Boughton Atturñ for the Deft pleaded non est factum Whereupon Smith was sworne & Jno Simpson who say that Wm Smith writt the bill & James Lee Signed it & Delivered it Where- upon the Court Gave Judgmt agt the Deft for eight hundred fifty Eight pounds of tob wth Cost & Chargs of suite then the plt produced [p. 126] this bill of Chargs wch was allow'd p the Court To his owne Attendance 3 daies 90 To John Simpson 3 daies 90 To Wm Smith 3 daies 90 To Atturnies Fees 60 330 19 |
