140 Charles County Court Proceedings, 1668—16 70. Liber D Miles Chaffe Defendt made his Personall appearance to Defend the Suite Comenced agt him by the said Walter Pake as aforesd The Plaintife entered William Price and the Defendt entered George Thompson as their Attorneys in the said suite Whereupon the Plaintifes Declaracon was read in Crt to the effect as followeth (vizt) To the Worple the Commissionrs of Charles Countie. Walter Pake Plaintife Miles Chaffe Defendt In a plea of Debt And Whereupon the Plaintife Complaineth agt the Defendt For tht tht is to Say That Whereas the said Miles became indebted to the said Walter in the full and just quantitie of Seaven hundred Ninetie five pounds of tobaccoe for the true Payment of wth the [p.3] sd Miles gave Bill to the said Walter Now soe it is tht the said Miles being a Nonresident person, and having no setled estat or setled Place of abode in anie part of this Province the said Walter humbly Craves tht this WorPle Court Require the said Miles to give him Sufficient Securitie for the Payment of the said Debt And &c. Hereupon the Defendts Attorney entered his Plea that Secundum Actionem Nihil adhuc debet, & tht the Defendt is noe nonresident person because he had agreed for his Accomodacon this yeare within this Countie and hath undertaken Severall Imployments whereby to enable him to Pay the aforesaid Debt The Premises Considered the Judgment of the Court is tht the Writt of Arrest not Specifleing anie Securitie tht the Defendt should give, but onlie tht he should be taken into the Custodie of the Sherrife upon a Plea of Debt when as yet the said Debt was not due, nor Recoverable Therefore the Defendt ought not to be Com- pelled to give Security for the same Whereupon William Price Attorney of Walter Pake the Plaintife Craveth an Appeale to the Provinciall Court wch is graunted Ordered Therefore That the Plaintife have Libertie to transmit a Coppie of the Proceedings of the Court in this Cause to the Pro- vinciall Court attested under the Clerkes hand. Mr Joseph Harrison & Mr Stephen Montague Administratrs of the estate of Richard Randall Decd Plaintifes came and made their appearance this Crt to Prosecute the Suite Comenced by them against Ignatius Causeen Defendt in a Plea of Trespasse upon the Case. Ignatius Causeen Defendt Came and made his Personall appear- ance this Court to Defend the Suite Comenced agt him by the said Adminrs as aforesd. Hereupon the Plaintifes in their Declaracon Complaine agt the Defendt for tht tht the Defendt was indebted to the said Richard |
