110 Charles County Court Proceedings, 1666—1668. Liber C of the Act as it is our opinion he ought to have done, and we con- ceave that it is at the Defendts Election to give the Plaintife Corne, and Cloathes, or tenne pounds Sterling wch he pleaseth The Defendt hereupon Craves an Appeale to the Provinciall Court which is graunted Ordered Therefore That the Plaintife be free unlesse the Deft Prosecute the appeale and that the Defendt satisfie and pay unto him either 10 lb Sterling or Come, and Cloathes as in the act is provided wch he pleaseth wth Costs Knowe all men by these presents That we James Lyndsey and James Macoy have received of mr Stephen Montague Adminr of the Estate of Captaine Robert Troop latelie decd a Pattent for the quantitie of five hundred Acres of Land lyeing upon the Anacostin called Scotland yard which the said Captain Troop bequeathed unto us the said James Lyndsey and James Macoy aforesaid, and to our heires for ever from wch Legacie we doe hereby acquitt and dis- charge the said Stephen Montague for ever In witnes whereof we have hereunto Set our hands and Seales this 13th Day of Novem ber 1667. James Lyndsey Test Richard Boughton his Thomas Allanson James Macoy marke Thomas Elsey entereth the marke of his hogges and Cattle vizt overkeeld, and underkeeld in the Right eare and a Crop and two Slitts in the Left eare. [p. 248] John Dent entereth the marke of his Hogges and Cattle vizt overhalvd in the Right eare, and Cropt on the Left Francis Glyn Entereth the Marke of his Hogges and Cattle vizt The Right eare Cropt overkeeld and underkeeld and the Left eare Swallowe forked. John Bond, and Edmund Lyndsey enter the marke of their Hogges and Cattle vizt Cropt on the Right, underkeeld and a hole in the Left. Whereas Mr James Lyndsey presented an Account of one Thou- sand two hundred and fourtie pounds of tobaccoe due unto him from Richard Randall latelie deceased for Physick tht in his life time he had of him, and the Administrators of the Said Randall vizt mr Stephen Montague and Mr Joseph Harrison acknowledged a Judgment to Mr Lyndsey for the same It is Ordered That the said Montague and Harrison Satisfie and pay unto the said Mr Lyndsey the aforesaid Sume. Thomas Henshall Sworne Saith That he Saw Arthur Turner latelie decd Signe a Bill produced in Court passed by the said Turner in his Life time to Mr Benjamin Rozer |
