108 Charles County Court Proceedings, 1666—1668.
Liber C To the Worple the Commissionrs of Charles Countie.
The Plaintife Declares agt the Defendt in an acon of the Case
fon tht the Defendt is indebted unto the Plaintife fon eight Barnels
of Conne, the Plaintife having demanded of the Defendt is Denied
paymt of the same and theneupon he brings his suite
Hereupon the Plaintife Subpaenad Jo. Lambert Ellener Lambert
his wife, John Mun, and John Boyden in open Court
Ellener Lambert Sworne in open Court Saith That Thomas
Allanson Thomas Winder and William Bateman being about the
Spring of the yeare at the house of John Lambert the said Winder
and Bateman being both j oynt mates did Conclude to give the sd
Allanson sixe Barrells of Corne that they owed him and to pay
him at Mr Hanrisons house and likewise two Barrells more for
spoiling bedding and other goods
[p. 246] John Lambert Saith That he heard Thomas Allanson discoursing
with William Bateman about sixe barrells of Corne and that Bate-
man told him he might goe to Luke Green and receive it
John Mun Sworne in open Crt saith That he heard William Bate-
man say That he owed Mr Allanson sixe Barrels of Corne sometime
in the yeare 1666, and that he heard John Boyden promise Mr
Allanson That he would take a Bill for the Corne which Bateman
and Winder owed him
John Boyden Sworne in open Crt saith That Mr Allanson did
Desire him to take a Bill of Thomas Winder, and William Bate-
man, but for what he knoweth not
Ordered That there be an Imparlance of this Busines till next
Court

in a plea of Debt
The Plaintife and Defendt making their appearance, the Plaintife
by his Attorney and the Defendt by himself e the Plaintifes Declaracon
was read in Court as followeth vizt
The Plaintife Declares against the Defendt in his Action of Debt
for 10 lb Sterling and one good Cloath Suite of Kersey a Shift of
White Linnen, one new paire of Stockins and Shoes two hoes and
one Axe being for and in Consideration of 4 yeares Service as
more at Large may appeare by the said Raistons Indenture bearing
date the 27th of July 1663
The Defendt entereth as his plea That the Plaintife is not free
by reason tht Assignmt being made of him from Henrie Robbertson
to Daniell Johnson, and before such assignmt he having ran away
and absented himself e from his Master Robinson, the Defendt Con-
ceaves tht by virtue of such Assignment aforesd Daniel Johnson
ought of right to have such benefit by his said Running away, as
