John Walton Plaintife Samuel Dobson Defendt Liber C
in a plea of trespasse upon the Case.
The Plaintife, and the Defendt made their appearance by them-
selves, and the Plaintifes Declaracon was read in Court as followeth
vizt.
To the Worple Comissionrs of Charles Countie
The Plaintife Declares agt the Defendt for tht the Plaintife
having a Chest of Severall goods at Mr Walter Beanes house and
delivering the key thereof to the Defendt to give the same to Mr
William Marshall whom the Defendt (having in his absence from
this Countie entrusted him all his other goods) desired that he
would send for the said Chest from Mr Beanes aforesd but the
Defendt subtillie Contriving to defraud the Plaintife of the said
Chest of goods never delivered the key thereof to the sd Mr Marshall
but demanded the Chest of Mr Beane pretending that the Plaintife
was indebted to him to the value of the said Chest of goods and
upon Mr Beanes Denyall of the said Chest he this Defendt presumed [p. 245]
without anie order from the Plaintife soe to doe, to open the said
Chest and take out the goods therein and Carrie the same away
and upon the Plaintifes Demand of the said goods from the Defendt
he hath been and still is Denied the same Whereupon he Craves
order of Crt for the said goods or the value of them could not
amount to lesse then the Sume of about 5 or 600 lb of tobaccoe
together wth such Damages as this worple Crt shall please to award
for the said wrong and injurie And &c.
Hereupon it was prayed by the Plaintife tht Mris Beane Sub-
paenad to the Court on his behalfe might be Sworne wch was done
accordinglie
Mris Beane Sworne in open saith That John Walton left a
Chest at mr Beanes and tht Samuell Dobson came for the Chest but
tht mr Beane refused to Deliver the chest unlesse the said Jo. Walton
came himselfe for the same; and this Deponent saith That She
bid the said Dobson take out what was in the Chest if he would,
and further saith That the sd Dobson did take out nothing but an old
combe-Case, an old paire of Milld Stockins, and a paire of shoes
to the best of this Deponth knowledge
The Plaintife hereupon Craves Imparlance till the next Court,
tht he may bring further evidence of the truth of his Declaracon
was graunted
Thomas Allanson Plaintife William Bateman Defendt
in an aeon of the Case.
The Plaintife and the Defendt made their appearance in Crt for
themselves and thereupon the Plaintifes Declaracon was read as
followeth vizt.
