that the Inspector or Inspectors of the several Warehouses shall and
are hereby Obliged and required on the first day of every August
Court during the Continuance of the Act to return to the said
Court a distinct and fair List of the Marks Numbers Tare and Nett
Branded Weights of every Hogshead of Tobacco then in their Sev-
eral Warehouses respectively that have been inspected above three
Years to be lodged with the Clerk of the County and the Justices
are hereby required to cause a Copy of the said List to be imme-
diately set up at the Court House Door Advertising the Tobacco
therein mentioned to be sold on the third day of the said Court if
fair Weather and if not the next fair day and shall cause the same
to be Sold at the time aforesaid At Publick Vendue in Single Hogs-
heads and the Produce thereof shall be Applied to the defraying the
County Charge And Whenever thereafter the Owner or Owners of
such Tobacco shall Claim the same or any part thereof and make
his her or their Property Appear to the Satisfaction of the said
Justices then the said Justices shall Assess in the next County
Levy such sum as such Tobacco Sold for, for the use of the said
Owner or Owners

Provided always that if any Owner or Owners of any Hogshead
or Hogsheads of Tobacco which shall be returned in such List shall
within two Months next before the said Court of Sale give notice
in Writing to the Inspector or Inspectors of the Warehouse in which
such Tobacco lies of their being Owner or Owners thereof Describ-
ing in the said notice the Mark Numbers and Nett Weight of such
Tobacco and that they are unwilling the same should be Sold such
notice or Notices shall be by the said Inspector or Inspectors re-
turned and lodged with the said List and such Tobacco shall be
Marked not to be Sold in the Copy before directed to be set up
nor shall the same be Sold any thing herein before contained to the
Contrary Notwithstanding

after it is so listed be Deemed taken or Allowed to be a legal Tender
in any Tobacco Payment what any thing herein Contained to the
