Daniel Dulany Esq.r from the Upper house delivers to Mr Speaker
the Bill Ent,d An Act for the Advancement of Justice Ind.d By the
Upper house of Assembly 28.th Oct.r 1763

Read the Second time & will pass with the following Amendments,
in page 2d Line 5,th from the Bottom leave out the Words to plead
to issue the same Court & so to the End of that page, and instead
thereof the following Words, to proceed to tryal the Court, and if
the Def.th Shall refuse or Neglect to Answer or plead to render Judg-
ment for the Plaintiff with Cost of Suit unless Sufficient Cause be
Shewn by the Defendant why there should be an Imparlance, after
the Words dispute in 2d line of 3d Page instead of the words shall


not exceed the Sum of Twenty Pounds Sterling Money or five
Thousand Pounds of Tobacco, insert the following Words, is not of
Sufficient Value to remove the same into Chancery, after the Word
have in 4th line of the 4th page insert the following Words in his
Own Name as Assignee, after the word, had in the 6,th line of 4-th
page insert the following Words Vizt the said assignment being first
recorded in the same Court wherein the Judgment Shall have been
rendered or Obtained, and in 6th Line from the Bottom of the
Same page before preceding, put Equitable Course after the Word,
mentioned in 5.th line of 5.th page insert the following Words, in Case
the said Assignee hath not been nor shall he a Surety in the Bond
or Obligation Assigned to him as af,d after the Word Assignee, in
the 10,th line of the same page insert the following Words, upon any
Assignment wherein the Obligee or Obligees may be liable under
this Act upon the default of the Obligor or Obligors as af.d and
leave out the last Clause in the Bill.

The Order of the Day being read; the house referred the Con-
sideration on John Stone Hawkins's petition, untill the Morrow &
ordered that the same be then taken into Consideration.
On Motion of Colo Tilghman, leave is given to bring in a Bill for
raising a duty of f 5. a head on Negroes to be imported for the better
Support of the Several County Free Schools; ordered that Col.o
Tilghman Mr Allen M.r Ringgold & M.r Hall, do prepare & bring in
a Bill accordingly
