and Purposes as if the said William Clajon and Mary his Wife
were in their own Right Seized of and in the like Estate in the
said Lot and Houses as the said Gamaliel Butler was Seized of
at the Time of his Death and the Monies arising on Such Sale
or Sales to lay out and apply and dispose of for and Towards the
Payment and Satisfaction of the Debts of the said Gamaliel Butler,
which he did owe at the Time of his Death and still remain due
and unsatisfied and to the Satisfaction and discharge whereof the
Personal Estate of the said Gamaliel Butler is chargeable and
bound and will not extend in Proportion to the Sums of those
Debts respectively in a Course of Equitable Administration And
the Overplus thereof (if any) shall be and remain and shall be
secured for and paid to such Person or Persons in the Same Manner
and Proportions as the Lot and Houses which in Virtue of this
Act shall be sold would lawfully and of Right belong and to the
End that discovery Should be made of such Overplus if any such
should be and that the same may be duly Secured accordingly.

Be it Enacted that the Said William Clajon and Mary his Wife
shall before such Sale or Sales give Bond with Sufficient Security
to the Commissary General of this Province in the Same Manner
and form as is usual in cases of Intestate Estates (which Bond
shall be lodged in the Prerogative Office) with Condition to the
Same that the said William Clajon and Mary his Wife shall dispose
of and account for the Monies arising by such Sale or Sales agree-
able to the Intention of this Act and Shall at such Sale or Sales
Produce a Certificate from the said Commissary of Such Security
having been given and also that the Said William Clajon and Mary
his Wife shall within Six Months after any Vendue as Aforesaid
Account with the Commissary for the Produce of such Sale or
Sales and give Security for the Ballance (if any) in the same
manner as if the same was properly Personal Estate to be distributed
and paid according to the meaning and Intention of this Act.

Provided Always and be it enacted that this Act shall not extend to
impower the said William Clajon and Mary his Wife to burthen or
Charge the Orphan of the aforesaid Gamaliel Butler or any Person
or Persons claiming by from or under him with any General or
other Warranty than against Gamaliel Butler and his Heirs.
