Provincial Court Proceedings, 1668—69. 411 Whereupon it is Ordred that the said Attachmt be Continued and Liber FF that the sher of Caluert County doe make a better returne of his last proceedings therein William Moffett of Caluert County one of the Coroners of the said County petitioneth the Court for Seuerall fees due to him as Coroner and not sattistyed Ordred that the fees for Constables and Coroners bee Considered of the next Assembly George Monroe Complaint Morecroft p quer: [p. 755] Henry Hyde Nico Bead and Eliz: his wife defendants Caluert p deft The deft was last Court Ordered to put in his Answere to the Complts Bill wthin tenn dayes, which being done the Complt doth now deliuer into Court his Replicacon, whereupon time is giuen the defendt to rejoyne till tommorrow morning Reymond Staple fort plaintiffe Morecroft p quer. John Bayley defendt Rozer p deft This Cause resplted from last Court when Ordred that the defendt doe put in his plea this Court, which is as followeth And the said John Baley by Benja Rozer his Attorny Comes & de- fends the force and Injury when &c: and saith that the sd Reymd Ought not to haue his accon against him because hee saith that the Bond alleadged is not his deed Benja Rozer And the said Reymd saith as formerly hee hath Said that the said writeing is the deed of him the said John Bayley and of this hee puts himselfe upon the Country And the said John Likewise, Wherefore ordr is giuen &c The defendt in Open Court Con fest the Bond to be his deed, wher- upon Judgmt past for the plt: John Halfhead Complt Morecroft Joseph Edloe defendt Caluert Time giuen the deft last Court till the 7th day of January to put in his Answere to the Complts Bill in Chancery, which being not accordingly done, the Comptt Craues Cost agst the deft wch is granted Whereupon the defendt doth now deliuer into Court his Answer in writeing and upon Oath to the Bill exehibited agt hime, And Ordred that the Complt doe bring his wittnesses to be Examined before the Chancellor to declare upon Oath what they know in and Concerning the prmisses Oliuer Hollaway Complt: Time being giuen the Complt to put in John Homewood defendt his replicacon to the defendts answere |
