190 Provincial Court Proceedings, 1667. Liber FF or any of them or of or by any other pson or psons whatsoeü law- fully claiming by from or under thm or any of them or to their or any of their uses or by their or any of their titles Estates meanes or procuremts & the sd James Hussey for himselfe his heires executors & Admrs & all & singuler the premisses before bargained & sold wth their appurtenances & every part & parcell thereof unto the said John Hackister his heires Executors Admrs & asss to the intent & meaning aforesd shall & will warrt & for eü defend by theis pnts In wittnes whereof the pties first above menconed or named to theis present In- dentures have inkhangeably sett their hand & Scales the Day & yeare above written his mke Signed sealed a deliüd James I H Hussey Together with possession (sealed) of livery & seizin by turfe John Hackster & twigg in presence of us (seale) Robart Robines Richard Jones his mke [p. 477] Acknowledged by James Hussey in Open Court On the Eleaventh Day of April] One Thowsand six hundred sixty seaven to be the Right of the said John Hackister and his heires for ever Daniel Jenifer Clke To the Rt Honoble the Leivtennt Genll Chancellor & Justices John Hopkins yor honors petr in humility sheweth That whereas your peticoner att his arrivall in virga (being thn a Servt was sold unto one Wm Hardich for the time of 5 yeares with wch said Hardich your peticoner served three yeares att the Ex- piracon of which said terme of three yeares the Said Hairdich sold your peticor to one William Browne att Brittans bay late decd which sd Browne your peticoner served one yeare or thereabouts be- fore the sd Browne his decease & one other yeare being the Remayn- der of the said five yeares of servitude yor peticoner hath served to the Estate of the said Decedent Notwthstanding his true service ac- cording to the terme of yeares first menconed and Expired about the tenth day of November last past your peticoner is deprived and De- nied by Edward Clke & John warren Oüseers to the sd Estate of the decd of his corne & cloathes due to him as aforesaid [p.478] Your Peticonem therefore humbly Implore Order agt the Estate of Wm Browne deceased for his Corne & Clothes according to the act in tht case provided And your petr shall pray &c Ordered tht Edward Clarke and John Warren be Summoned to shew Cause why they do not pay the petr his Come & clothes Philip Calvert |
