74 Kent County Court Proceedings, 1648-1656. Liber A a yeare & a halfe, or theareab outs; declareinge his damadge; The deffendant denyinge the debt The plaintiffe dessire a Refference, which the Court is pleassed to graunt The deposi~ of mr Tho: Broadnox aged 57 years or theareabouts taken in the prsents of the Court sworn Examined & saith That in July in the yeare 1654 Jno Salter dessired yor depon~ & Roger Baxster to beare wittnes Concerninge a plantacon tht Jno Salter bought of mr Broockes of Marieland; uppon the Isle of Kent Comonly Called Beuer necke, & theire bargaine & agreement was as followeth; That the sd Jno Salter was to giue to mT Broockes, for the sd plantacon 1500lb of tob the next yeare after hee bought it, which was in the yeare And 1500lb of tob the next yer after which was in the yeare 1656, & upon this Couenaunt to pay 3000lb of tob as beefore, The said Broockes pmised to glue the said Salter peaceable & quiet possession of the fore mentioned plantacon, from all men & Further saith not; Sign mr Tho: T Broadnox The deposi~ off Roger Baxster aged 46 years or theareaboutes taken in the prsents of the Court sworn examined and saith That yor depon~ affirmes upon Oath all tht is mentioned & Exprest in [ ] deposi~ Verbatum & further saith not; Sign~ Roger R B Baxster Robert Martin hath petti~ the Court That wheareas Wm Price, Septembr Court last Complaind agst his wife in an Action of Deffa mation, upon proofe wheareof, an Order past for three hundred poundes of tob to the plaintife, & three hundred pounds of tobacco for publique uses; The sd Martin humbly Craues, Consideringe it was no fault of his, but his wiues weackenes & passion, & ailso Consideringe, tht this last sumer hee hath had [ ] pressures upon him, as is well known to the most in the Countie, That this worsh [ ] bee pleassed accordinge to theire wonted Clemencie to Remitt tht part of [ ] which was for publique usses Uppon the petti~ of the foresd Martin The Court is pleased to Order, tht accordinge to his dessire, & humble Request, the f ore- mentioned fine of three hundred pounds of tob for publique usses, shall bee wholly tacken of & Remitted, & tht it shall not bee Required of the sd Martin, to pay any part, or parcell theareof [ ] rnr Thomas Hinson of Kent one of the Justices off the peace, in [ ] Pressenteth to the Court [ ] of Misdemenoar, or agst mr Henerie Carlin [ ] depossitions heareafter followinge The depossition of Hassadia Hill aged 19 years or theareabouts, tacken in the prsents of mr Tho: Hinson the 25th of August 1656 sworne Exam~ & saith |
