44 Kent County Court Proceedings, 1648-1656. Liber A The Court doth thearefore Order that prsent paymt bee made out of the Estate of the sd Edward Tarrent of the foure hundred pounds of tob to the plaintiffe els Execution Wm Leedes pettissions the Court That wheareas bee stands Ingaged for the payment of seuerall debts due by bill and Accoumpts which weare to bee eqully payd by himselfe and Edward Tarent desseassed as will bee Justly proued & that hee is licke to bee much damnifled by Incombrances & suites of Law for that part of the aforesaid debts tht is Justly due to bee payd Out of the Estate of the said Tarrent, & no way owinge from himselfe Now wheameas the Estat of the sd Tarrent desseassed is in the Charg & Custodie of Capt Joseph Weickes hee beeinge ouerseere to the Estate The plaintiffe humbly Craues tht the sd Estat may bee liable to make payment of tht part or tht half e of the debts tht the sd Tarment stood indebted to pay at the time of his death And tht theare may bee no doubt or scruple in the Cause, hee hath drawne up all the pticulers as followeth & plast the debts in their due place & Order as the ought to bee payd, thos undr his own name bee ownes to discharge & those undr Tarrents name his Estate is liable to pay Debts Due by bill & accoumpt from Wm Leeds and th estate of Edward Tarrent Desased LeedesTarrt DebitorDebitor By bill to m' Tho: Hinson 1350 0675 675 By bill to Robt Martin1000 0500 500 By bill to George Hall0420 0210 210 By bill to mr Broune0566 0283 283 By bill & acc° to Capt weicks 0520 0260 260 By bill to mr Hinson0215 0107½ 107½ By Acco~ to mr Coni'0200 0100 100 By Acco to Jn° Winch0164 0082 082 By &c to mr Brodnox0020 0010 010 Sumary totull 4455 Suma totu The plaintiffe hauing giuen full satisfaction to the Court tht his demaund is Just & equall & in all pticulars hath made aparant his Declaration, wth Just proof The Court doth there for Ordr that all those debts that Edward Tarrent owed at the tyme of his death; (hauinge apeard by Just proofe) and are now to bee payd out of his Estate, shall bee payd and discharged by the fore named Capt joseph Weickes ouerseere to the sayd Estate, Or otherways tht the sayd Capt~ Weickes shall saue, keepe harmles, & undamniflied the sayd Leeds From all & euery part of the Formentioned Tarrents debts |
