40 Kent County Court Proceedings, 1648-1656. Liber A The Court doth thearefore Order tht prsent payment bee made of the one hundred & twelue pounds of tobacco with Court Charges els Execution Thomas Witherell hath mad his Complent tht the Estat of mr Nicolas Broune desseassed is indebted to him twoe hundred poundes of tob & hath proued his Complaint; The Court doth thearefore Ordr that prsent payment bee made of the twoe hundred pounds of tobacc°, out of the Estat of the sayd Broune els Execution Anthony Calloway haueinge mad his Complaint or declaration by way of pettission; That twoe men beelonginge to Accomacke named Tho Poier & Wm Johnson not longe since Came upon this Island & Caned away Contrarie to an Acte of Assembly on Robert Gamer which standeth indebted to yor pettissioner by bill three hundred & fifty poundes of tob & one barrell and a halfe of Indian Corne And yor pettissior haueinge layd an Atatchmt upon theire boat & saill with twoe Oares: Hee humbly Craues an Ordr for prsent paymt accordinge to the sd Act The depossition of John Winchester aged 29 yeares or theare aboutes sworne Examined & saith: Interogatonies First Whether Poier & Johnson Caried away Gamer & wheare hee was landed Ans :~ Gamer went in the boat with them and landed to the best of their knowledge at the head of Elke Riuer 2 Int Whether the boat was not dessigned to the head of Elke Riuer beefore they went of the Island Ans: No: but to goe to Swane Island 3 Int By whom & whether you weare hired, to bringe or Carie the boat or men Ans : Noe wee weare not hirred The depossition of Henerie Telior aged 26 yeares or theareabouts sworne Examined and saith the Same; which the sd Winchester doth Affirme or Ansr beeing like wisse Examined upon the same Interogatories The Complaint Charge & debt beeinge made apeare by twoe suffissient wittneses The Court doth thearef ore Ordr tht seissure by way of Execution shall bee made upon the sd boat saill & oares for the sattisfaction of the sd debt of three hundred & fiftie pounds of tob & one barrell & a halfe of Indian Corne with Court Charges mr Loid hauinge moued the Court against Capt Russell for a debt of fiue hundred Eaightie one pound of tob which the sd Loid pleads is due upon this ground tht the sd Russell was the cause of |
