Kent County Court Proceedings, 1648-1656.27 The Court doth therefore Order, tht the Jno Salter shall accord- LiberA ing to an Order from the Prouinciall Court, dated Octobr 18th 1654 and thearein Exprest, tht whoesoeuer should bee found to dispossesse Izack Iliue of the quiet Enioyment of his plantacon, should pay the Charges of the suite Ocassioned by the sd dispossessor which now the Coup hath found to bee John Salter; And thearefore doth Order tht the sd Jno Salter shall pay unto mr Iliue uppon all demaunds, seauen hundred fourtie seauen pounds of tob in Caske, which is the wholl Charges of the suit now, at this Court & formerly at the Prouinciall Court Expended mr Henery Morgan, in behalfe of mrs Broadnox, & by her Request, hath desired a Refference, to the next Court, in an Action of Slander, whearin Jno Salter is plaintiffe; The Court doth thearefore graunt the same Wheareas Mathew Reade, Jno Salter, Wm Price, Henery Telior, Henery Clay & Marie Croutch, (for misbehauior, in deboist drink inge, pphaning the Sabbath & sume of thm shutinge of, or discharg inge gunes, unseasonablie; all which hath beene made suffissiently appeare) beinge sumond to this Cou't & hath deserud punishment, upon theire promis of Amendment, & beeinge their first Offence, after Admonission, theire Offence is Remitted, payinge Court Charges els Execution The depossition off mr Tho: South aged 30 years or theare abouts taken in Court the 25th of Aprill 1655 Sworne Examined & Saith That about the midle of July last past, Franchis Broockes of Marieland Came to the place, wheare yor deponent lued, & tould him that hee had giuen Jno Salter possession of Beuernecke, and upon that possession giuen, yor deponent Came theare to hue, as as Co partner in the plantation, with the said Salter and further saith not Bee it known unto all men by theese prsents That whearas my [fol. too] husband Henery Carline in indebted to mr Henery Morgan a Certaine summe of tob I Rachell Carline doe by vertue heareôf for securinge of the sd tobacco to mr Henery Morgane bynd ouer foure head of Cattell vid on cow, on twoc yeare ould heiffor on femall yearlinge & one steere of twoe yeare ould all marked with a flouredeluce in the left eare and Cropt on the Right eare, I doe allsoe bind ouer all OUr stocke of hoggs marked as afforesayd & all the sayd goods soe to rest and remaine for securitie to the sd mr Henery Morgan his heires Executors Administrators and Asignes till such tyme as the sayd tobacco bee satisfied and payd & for Confirmation heareof I haue heare unto put my hand this [blank] of June 1655 |
