26 Kent County Court Proceedings, 1648-1656. Liber A Wheareas mr Nicolas Broune dessired of the Prouiciall Court, a Refference to the Cout at Kent, Concerninge an Action of slander, whearein the sd mr Broune is deffendant, & Jno Deare plaintiffe, And it hath appeard by three suffissient wittneses tht the sd mr Nicolas Broune hath slandred the sd Jno Deare, in sayinge tht hee was a Theiffe, & tht hee had stollen mr Littletons plate The Court doth thearefore Order, tht the sd mr Nicolas Broune shall in Open Court, Aske the sd Deare forgiuenes, & shall pay towards the reparation of the plaintiffs Credit, Fiue hundred pounds of tob and Caske, & for a Fine flue hundred pounds of tobacco & Caske, For publicke usses, as the Court shall thinke Fitt, and the sd tobacco to bee payd upon all demaunds with Court Charges & to remaine in the sheriffs hands till hee pforme the Order John Deare (by his Attorney Leiuetennant Hinson) Complaines agst mr Nicolas Broune, in an Action of slander, agst his wife, hauinge proued by two wittneses, tht the slander is euident & aparant The Court in Consideration of the sd slander, hath Ordered tht the sd mr Nicolas Broune shall in open Court aske Forgiuenes, of the sd Deares wife, & acknow his Offence, & shall pay a Fine of three hundred pounds of tobacco in Caske towards the Reperation of the plaintiffs Credit with Court Charges els Execution Whereas mr Nicolas Broune hath beene Cast in Court, in twoe Actions of deffamation, the on Against John Deare & the other agst his wife, both beeinge proued by suffissient wittnesses, yet not withstandinge, the sd mr Broune Reffusses to obey the sd Orders of Court, and dessires, an Apeall to the Prouinciall Court, prtendinge his further testimonie to make his scandall appeare theare Thearefore the Court is pleassed to Ansr his dessire, & graunt him an Apeall to the next Prouinciall Court, puided hee put in suffissient securitie, to the sheriffe for treble Dammage, if hee bee Cast in the suit, & till hee giue securitie, to Remain in the shereiffs hands mr Morgan (Attorney for Peeter Knight) Complains agst mr Conier in an Action of debt, due to the sd knight, by bill under hand from Robert Short desseassed, the sd mr Conier beeinge Administratr of the disseasseds Estate the bill beeinge disowned by the said Adminir & no more but one wittnes to the bill, It is thearefore the Judgment of the Court tht the sd bill is not Authentik mr Izake Iliue Complaines agt Jno salter tht hee hath molested him upon his plantation, hauinge a bill of sail under Broockes his hand & possession giuen him by Broockes, as in Court hee hath, acknowledged, & upon this accoumpt kept possession, & made usse of sume part of the fruit |
