Chancery Court Proceedings, 1673. 427
Discharge for said sum as also from all suits already Comenced by Liber P C
the said Bailey against yor petr, and for that pt wch is adjudged to
belong to Mr John Nethway of ifyall marchant that this hono.ble Cort
will please to ordr how to be Disposed of and that a power be given
to yor petr to Recover the debts made in Nethway's name
And yor petr shall Ever pray &.c
Upon Reading the foregoing peticion of Capt James Neale in
open Co.rt and the said John Bailey being prsent it appeared that the
said Bailey had Received Only thirty six thowsand four hundred
and fourteene pounds of Tobacco of the said Neale, wch said sume
the said Bailey Did acknowledge here to have Received as aforesayd
and no more and it is by the Cort ordered and adjudged that Capt
James Neale hath full power to sue any of the Debtors of John
Nethway of ffiall marchant whose bills he hath in his hands and that
he may Recover the said Debts by virtu of his Ltr of Attorney
from Nethway accordingly.
At a high Cort of Chancery held in Charles County Cort
house on the 26th of June 1673 Present Cheife Judge his

wife and John Gittings and put in their plea and Desired the same
might be allowed, but now appearing for the Complt This Cort hath
ordered the argueing of the same on the next Provincial Cort in
November next.
Thomas Gannt being served with a subpcoena Recd this day ap-
peared but finding no bill Exhibited agt him prayed Costs wch Re-
served also to the next Co.1t
