54 Provincial Court Proceedings, 1663. Liber B B To the honble the Gouernor & Councell of Maryland. The humble Petn of Willm Whittle Sheweth. That whereas one John Horne att a Court held att New Towne the 25th Octobr 1659, against yor Petr who marryed wth the Admis tratrix of one Thomas Williams in Virginia obtayned an order for 645£ Tob & Cask wth forbearance & Costs of suite Conditionally tht yor Petr should produce a Quietus Est, by the Last of Decembr then following, uppon the sd Estate, or else to pay the aforesd Tob, Wch yot Petr endeauoured to doe, But by reason of the Crosnes of winds & weather could not prforme wthin the time limitted by the aforesd order of Court, ffor wch reason yor Petr was constrayned to pay the aforesd Tob, though the Admistratrix of the sd Williams had order by a Court of Virginia for her Quietus est long before. Wherefore yor Petr Craues releife agst the sd Horne & humbly Craues tht yor hones would graunt him order tht the sd Home shall repay back the Tob to yor Petr wth Costs of suite And hee shall pray &c: Att a Court held att New Towne for the County of St Maries the 25th of Octobr 1659 prnt Philip Caluert Escp Secretr Mr Robt Slye Mr Rich: Willan Coll Wm Euans Mr Tho: Mathews Comisrs Mr Wm Barton To the worl the Commissrs of the County of St Maries. That whereas the Estate of Thomas Williams is indebted to your [p. 89] Petr the sume of 645l of Tob & Cask, as by Bill appeareth, And whereas Willm Whittle of New Towne hath lately marryed the Relict & former Wife of Thomas Williams aforesd, & is now possest of the sd Williams Estate, Yor Petr humbly Craueth order for the sd Debt from the sd Whittle wth 144£ Tob Charges for forbearance & Cost, & yor Petr shall pray &c: Vppon wch Petn The Court doth order tht Willm Whittle who marryed th Relict, Widow of Thomas Williams, Produce a Quietus est uppon the estate of the Thomas Williams by the last of Decernbr next, or pay unto the plf six hundd fowrty flue pownds of Tob. & Cask forbearance & Court Charges, else execüon. Know all men by these pnts tht I John Edmondson haue ordayned in my stead & place putt & constituted my honest ffreind Rich: Collett to bee my true & lawfull Attorney for mee & in my name & for my use to aske & sue to receaue of all & euery prson or prsons whatsoeur all summes & debts of Tob. web are or shall bee due unto mee John Edmondson, or any other web hath imployed mee, Gyuing unto my sd Attorney by these prnts my full & whole power & authority in & about the premises, & for such Debts or surnes of Tob as aforesd to |
