134 Provincial Court Proceedings, 1663-64. Liber B B signes, or by any other prson or prsofls whatsoeur Lawfully clayming by from or under him them or any of them, or by from or under his or their meanes Act consent tytle interest priuity or procuremt (Excepting & foreprizing the Rent hereafter expressed to bee payd unto the sd Thomas Gerard & his heyres by the sd Thomas Nottley & his heyres (to say) one Barrell of shelled Indian Come and a Cowple of Lapons to bee payd therefore yearely once a yeare att the mannor of St Clements aforesd ffowrty dayes afore or after the natiuity of our blessed Sauior And further the sd Thomas Gerrard for himself e [p. 182] his heyres Executors & Adthistrrs doth couent promise & graunt to & wth the sd Thomas Nottley his heyres & assignes, tht hee the sd Thomas Gerard his heyres & assignes & all & euery other prson & prsons & their heyres Lawfully hauing or clayming or rightfully pre tending to haue or wch hereafter shall or may Lawfully haue or claime, or rightfully pretend to haue any Estate tytle interest or demand into or out of the prmises or any parte, or parcell of them by from or under the sd Thomas Gerard his heyres or assignes shall bee & will from time to time & att all times during the space of Seauen yeares next ensuing the date of these prflts att & uppon the resonable request att the Cost & Charge in the Law of the sd Thomas Nottley his heyres or assignes make doe prforme acknowledge, Leauy Exequute & suffer, or cause to made, done, prformed, acknowledged, Leauyed, Exequuted & suffered all & euery such further Lawfull & reasonable Act & Acts, thing & things, deuise & deuises, assurance & assurances, & conueyances in the Law whatsoeur for the further better & more prfect assurance, surety, sure making & conueying of all & singular the before hereby graunted or mentioned to be graunted prmises wth their & euery of their Rights, members & appurteñces unto the sd Thomas Nottley his heyres Executors & Admistrrs bee it by ffine or ffines, ffeofment or ffeofments Deed or Deeds, Enrolled or not Enrolled, the Enrolemt of these prnts Recouery or Recoueries, single or dowbie Voucher or Vouchers Release or Confirmaon, or by all & euery, or any the wayes or meanes aforesd, or by any other wayes or meanes whatsoeur, as by the sd Thomas Nottley his heyres or assignes, or by his or their Councell Learned in the Law shall be reasonably deulsed aduised or requyred Soe as the su Thomas Gerrard his heyres & assignes, or such other prson or psons who shall bee requyred to make such further assurance bee nott compelled or compelleable to trauell further then St Maries in this Prouince, or to the usuall place where the Prouinciall Court shall for the time hereafter to come bee held in or about the making thereof.
