pounds Currt Money to be by him expended in the Purchase of Wood
for the use of the Governor & Council. —

[Wm Paca, Annapolis, To the Honorable The Judges of the
General Court.]

I have the Honor of yours of the 6th Instant in answer to mine
of the 21 October last past.
Your Construction of the Confederation is very different from
my Ideas of it, and I find I have been much mistaken with Regard
to the legal Principles of your Proceeding in the Affair of Mr
Carbury. —
You are of Opinion that Mr Carbury's Offence abstractedly con-
sidered from our Treason Act could not be cognizable here before a
Demand of him by the Executive of Pennsylvania. There is nothing
I think in the Confederation, which says so, and in my Judgment
such a Construction of it would defeat both the Object and Policy
of it. Mr Carbury indeed could not be delivered up before a Demand
but I cannot conceive why he should not be Arrested and his Offence
so far cognizable before such Demand. I see no Ground at all for
the Construction that the Executive only of the Offended State can

charge the Criminal : I think any Man whatever Conuzant of the
Offender's Guilt may charge him and on such Charge if the Evidence
affords probable Grounds of Belief the Offender might be arrested.
