an Affair which must rest with yourself. You are required to take
Bond with Security, if you are disposed to dispense with the Law,
and take a verbal Assumption the only Consequence will be, that you
will be Answerable out of your Own Pocket in Case of failure.
Naval Officers as well as other Public Officers frequently grant In-
dulgencies : but then they are always at the Peril of the Officer. To
act safely and without Hazard we should make the Law the Rule of
our Conduct, and never Assume a Discretionary Power to depart
from it.
The Jurisdiction of a Consul is very limited where there is no
Treaty to ascertain it's Extent : We knew of no such Character as
the Consuls Chancellor And we are sure if such Character exists in

the Powers given by France to the Consul he cannot be answerable
to our Authority or Courts in that Character. But why can't the
Consul enter into Bond with the Masters of the French Ships and
become their Security as the Law directs? He may execute such
Bond as a private Individual tho' not in his Political Character as
Consul, and thus all Difficulties will at once be removed. You only
are to Judge of the Sufficiency of the Security; and if the Sureties
offered are Competent in their Circumstances, it is all the Law re-

Friday 13th June 1783.
Present the Honorable
Benja Stoddert, Gabriel Duvall, Jeremiah T. Chase, James Brice
and John H Stone Esquires. —
Ordered that the western shore Treasurer pay to Daniel of St
Thomas Jenifer Esqr Two thousand, five hundred and thirteen
pounds of Tobacco for the like Quantity lent the State in 1780 per
Account passed. —
That the said Treasurer issue a Certificate to Samuel Davidson
agreeably to the "Act proposing to the Citizens of this State, Credi-
tors of Congress &ca " for five hundred and forty one pounds and six
pence due him on Continental Loan Office Certificates adjusted by
the Depy Audr the 12th Instant
That the said Treasurer pay to Jeremiah T. Chase Esqr Twenty
pounds, twelve shillings and seven pence Current Money for One
Years Interest on four Certificates issued agreeably to the "Act to
adjust the Debts due from this State." —
