Letter 120

Portsmouth where a Guardship lay to protect them & they would
get 18 or 2o£ hard money p hogshead and that he heard the said
Anderson say he Anderson was in the Barge at the time when the
plundering party with one Robinson was at Lower Marlbrough &
that on this deponents making some Grogg he heard him telling
Mr Heathman sonething about the Engagement in the Bay between
the Porpus & Hibernia, but cannot tell the particulars

Letter 121

[Deposition of James Stone before E. Johnson, Calvert County]

The Deposition of James Stone aged about thirty three years being
duly sworn on the Holy Evangels of Almighty God deposeth &
saith that on Friday the 29th June last he was returning down the
Road he met a certain Thomas Heathman and after some Conver-
sation this deponent asked him what was become of the Man they
had seen at Hunting Town (that day) who had a pass from
Richard Barnes Esqr Heathman answered that he left him at Mr
Oggs & that they had been drinking Toddy together and asked this
deponent why he left Town so soon that had this deponent staid he
might have had a sufficiency of Toddy as he had treated him (Heath-
man) this dept made answer he did not want any of his Toddy why
says Heathman he was the Man that took our Tobacco at the mouth
of Patuxent River & further saith that Heathman & this deponent
lodged at Mr James Sewalls that night & that Heathman said the
Man told him if he Heathman had claimed the protection of the
English & have gone with them he would have been satisfied for the
Tobacco they had taken from him (or words to that Effect)

May it please Your Excellency & Honours. In Consequence of the
within order, I take the liberty of inclosing it, and hope your Excel-
lency and Honors will Comply with the Contents.

At a Court for the State of Maryland held at Charles Town in and
for the County aforesaid on the Monday before the second Tuesday
in and 12th day of March Anno Domini 1781
