forfeited Recognizance against Robert Cunningham, and John
McCandless his Security of Baltimore County having made it appear
to us that it was not from a Contempt of the Court that the Recog-
nizance was forfeited, that Cunningham did appear in Court the first
Day, and John Moore not appearing, Chalmers, who is solely in-
terested in the Dispute, (Cunningham being only the Agent) appre-
hended as it turned out, that the said John Moore, would not appear
and it being inconvenient and expensive for Cunningham to stay, told
him he might go home, but at the same Time requested he would be
ready to attend on the shortest Notice, which he promised to give
him, if he should be called for: We therefore request you to stay any
further Proceedings against the said Robert Cunningham and John
McCandless until our further Order, or until the End of the next
Session of Assembly.

If you cannot do all the Duties which the Assembly have annexed
to the Office of County Commissary and absolutely decline to under-
take the Collection of the Cattle required of Baltimore County, which
is the most essential Post at this important Crisis, we shall take im-
mediate Measures to displace you and appoint a Successor, to whom,
in that Case, you will deliver the Money, and you will also make a
Return immediately to James Calhoun Esqr Commissary General for
this Shore and adjust your Accounts as Commissary.

Friday 7th September 1781.

Ordered that the western shore Treasurer pay to Richard Flem-
ming one thousand nine hundred pounds of the Bills Emitted under
the Act for the Emission of Bills of Credit not exceeding 2OO,ooo£s
&ca of the money appropriated for the present Campaign to be de-
livered over as follows, eleven hundred pounds to Colo Thomas Price
Commissary of Frederick County and eight hundred pounds to Colo
Moses Rawlings Commissary of Washington County for the use of
their Departments on Account.
That the said Treasurer pay to John Woolfe five hundred pounds
of the same Emission of the money aforesaid to be delivered over
to Patrick Sim Smith Commissary of Calvert County for the use
of his Department on Account.
