[Council to Mr. Hercules Courtnay.]

Your Terms of Payment for the Cloths are such as we cannot
possibly comply with and therefore inadmissible. It gives us pain
to loose so favourable an opportunity of providing our Troops with
such Cloaths as are immediately wanted, but our Inability to comply
with a Contract of that kind must justify us in declining the Purchase.

[Council Circular to the Auctioneers.]

We have appointed you Auctioneer for County but you are
not to act as such till after the first Day of April next, before you act

you must take the Oaths to the Government required by Law (unless
you have heretofore taken them) under the Penalty of five hundred
Pounds and give Bond in the Penalty of two thousand Pounds
current money with such Securities as the County Courts of your
County shall approve with Condition that you will faithfully execute

the Office and Trust reposed in you as Auctioneer for County

agreeable to Law and in all things well and faithfully execute and
perform the several Duties required of you by the Act entitled " An
Act to regulate Auctions " and take the following Oath. " I A B
do swear that I will faithfully and honestly execute the office and
Trust reposed in me as Auctioneer, for County and will well and
faithfully perform the several Duties required of me by Law without
any Partiality Fraud and Deceit " Your Bond and Securities are
liable for the Payment of one Pound in every hundred Pounds of
property by you sold at Auction and you are once in every three
Months to account on Oath and pay the same to the Treasurer of
your Shore. Your Allowance as Auctioneer is as follows for house
hold Goods Cattle or live Stock 3 p Cent for Horses 2 1/2 for Ships or
other Vessels Houses or Land 1/2 p Cent for Goods wares and
Merchandize 2 1/2 p Cent, for Negroes one p Cent with a Power to
appoint a Deputy Auctioneer.

Ordered that the western shore Treasurer pay to Thomas Slaughter
sixteen Pounds, two shillings and six pence of the new Emission due
him per account passed by the Audr Genl
That the said Treasurer pay to Thomas B. Hodgkin four pounds
two shillings and four pence half penny of the same Emission in lieu
of one hundred and sixty four pounds, fifteen shillings due him per
Acc( passed by he Aud. Genl
That the said Treasurer pay to Joseph Dawson forty five Pounds
of the same per Account passed by the Aud. Genl
That the Issuing Commissary deliver to John Ward a British
Deserter on his way to Philadelphia two Days rations.
