the manner of Tenders in Tobacco; after which a Warrant was
issued by a Magistrate against him the said Lecompte, and Judg-
ment was given by a certain Mr James Billings, a Magistrate for
Dorchester County, altho the said Lecompte pleaded the Payment
aforesaid: Notwithstanding which, the said Billings issued an
Execution against the said Lecompte, whereby he was obliged to
procure Mr Thomas Nevett, of the same County, to pay the same,
whereby the said Lecompte hath doubly paid the Debt aforesaid.
Your Committee conceive, that the Tender and Payment made
according to the Directions of the said Act of Assembly, was a good
and sufficient Payment, and that the said Magistrates proceeding
to give Judgment and order Execution notwithstanding the same,
and notice thereof, was illegal and oppressive.
But submitted to the Consideration of the House.
Signed p Order E. Dorsey Ci. Com.
Which being read, the House concurs therewith, And Ordered,
that the Clerk issue Summons for James Billings the Person com-
plained against, to appear at the Bar of this House on Wednesday
the 28th of this Instant.
