Session Laws
|
Evidence on either Side, as if the original Lease or Leases should
be produced; and in cases of these Leases, no Acknowledgment shall
be requisite; but Leases made for the Premises aforesaid, or any
Part of them, shall be as effectual made in Pursuance of this Act,
as if no other Law had Relation to them; any Law, Usage, or Cus-
tom, to the Contrary notwithstanding.

XXV
|
An Act for raising a Duty of Three Half Pence Sterling per Hogs-
head on all Tobacco exported out of this Province for the Use of
the Governor.

Preamble
|
Whereas his Lordship the Right Honourable the Lord Proprie-
tary, has been pleased to constitute and appoint his Excellency
Samuel Ogle, Esq; his Lieutenant Governor in and over this his
Province of Maryland, to whom we yield all due Deference; and
the better to demonstrate the good Respect we have for and towards
the said Samuel Ogle, Esq; our present Governor, and the great
Hopes and Expectations we have of his Excellency's good and mild
Government over us, we most humbly pray that it may be Enacted ;

Duty, what
and how to
be paid
|
And be it Enacted, by the Right Honourable the Lord Proprie-
tary, by and with the Advice and Consent of his Lordship's Gover-
nor, and the Upper and Lower Houses of Assembly, and the Au-
thority of the same, That an Imposition of Three Half-pence Ster-
ling per Hogshead, over and above the Duties already imposed on
the Export of Tobacco, upon all Tobacco that shall be exported out
of this Province, after the last Day of this Session of Assembly, by
Land or by Water, and Three Half-pence Sterling upon every Three
Hundred Pounds of Tobacco, be it in Chest or Case, to be paid by
the Master of every Ship or Vessel, or other Person trading into or
living in this Province, in Sterling Money, or Bills of Exchange, at
the Election or Choice of the said Master, or others, to be collected
by the Naval Officer of the Port or District where such Ship or
Vessel shall Enter, and to be paid by the Naval Officers aforesaid,
to his Excellency Samuel Ogle, Esq; his Lordship's Governor in and
over this Province, for his proper Use and better Support.

In Case of
Loss, &c.
|
And be it further Enacted, by the Authority, Advice, and Con-
sent aforesaid, That if any Tobacco shall by any Casualty be lost
after the aforesaid Imposition paid, that then and in all such Cases,
the Owner or Owners of any such Ship or Vessel, or other Person
paying the same, shall have free Liberty to freight and ship off the
like Quantity without paying the said Three Half-pence.

Duration of
this Act
|
This Act to continue until the Twenty-ninth Day of September,
which shall be in the Year One Thousand Seven Hundred and Forty-
eight.

In Case of
Death or
Removal
|
Provided Always, That if the said Samuel Ogle, Esq; shall die,
or be removed from being Governor of this Province, before the said
|
|
|
