Read the second time the Bill entituled an Act for the Tryall of
all matters of Fact in the several Counties where they have arisen or
shall arise and Passed & sent to the Lower House with the following
Message by Colo Plater
By the Upper House of Assembly 18 Septr 1745
Gentlemen
Altho' We have Passed the Bill Entituled an Act for the Tryall

p. 84

of all matters of Fact in the several Counties where they have arisen
or shall arise without any Amendments Yet We must observe that
the Allowance intended by that Bill for the Justices of Assize is too
inconsiderable for the Trouble Care and Abilities of Gentlemen who
must by this Bill be intrusted with the distribution of Justice which
Concerns the Life Liberty & property of every Individual in the
Province therefore We recommend to Your Consideration that the
Allowance in the Bill may be increased to18000tt or fifty Pounds
Currency each Assize, and if Your House thinks proper to agree
to this Alteration it may be made in your House accordingly
Signed p Order J Ross Cl Up Ho.
