your Principal you will not willingly or wittingly charge other or
higher Fees than limited in the Act Entituled an Act for the Limi-
tation of Officers Fees which said Oaths before mentioned shall be
severally returned By the Magistrate before whom the same shall be
taken to the Principal or County Offices as the Case shall require and
be there entered on Record
And be it further Enacted that in Case any person or Persons to
whom such Fees as mentioned in this Act shall be properly charge-
able shall refuse to pay the same so the said Fees be charged as by
this Act is directed and by the Officers therein before mentioned it
shall and may be lawfull for the said Officers to recover the same
by way of Execution against the Tobacco or other Goods or Chatels
of the person or persons so refusing to pay the same Provided always
that such Person or Persons having no Tobacco and that shall refuse
to shew unto such Officer or Officers as shall Collect the same such
other Goods and Chatels it shall be lawful for such Officer or Officers
to take the Body or Bodies of such Person or Persons in Execution
of the same
Provided also that no Officer or Officers in this Act Mentioned
and whose Fees are hereby settled and Limited shall by Virtue
thereof either have or cause to be levied any Execution upon the
Body Goods or Chatels of any Person or Persons whatsoever for any
Fees in this Act Limited and Contained without delivering or caus-
ing to be delivered a true and just Account of the Fees to them due
by this Act as af^d under the Hand or Hands of such Officer or Officers
to the Person or Persons from whom such Fees shall be due at least
Thirty Days before any Execution or Executions shall be levied
And in Case [any] Officer or Officers before mentioned shall in any
sort act contrary hereto such Officer or Officers so offending shall
forfeit and pay to the party grieved five Thousand pounds of To-
bacco to be Recovered in any Court of Record within this Province
by Action of Debt Action on the Case Indictment or Information
wherein no Essoin Protection or Wager of Law shall be allowed.
And be it further Enacted that no Officer or Officers herein before
mentioned under the penalty af^d to be recovered as af^d shall make or
send out their Fees on Execution but once in every year and that
between the first day of November and the Twenty fifth Day of
December yearly during the Continuance of this Act And that the
party or parties charged their persons Goods or Chatels shall not
be Executed for any of the af^d Fees unless their Accounts be delivered
them at or before the Twentieth Day of February in any year they
shall Demanded
And be it further Enacted by the Authority af^d that wherever any
Surveyor returns a Certificate or Certificates for the Examination
of the Examiner and that the same shall be found erroneous that
in such Case the parti for whose use such survey is made shall not be
