from him, It is therefore Respited till next Court.

The plf produced Three Bills of the defts. One for one thowsand
twenty three pownds Tob. Another for Three hund pownds Tob.
& another for one Thowsand pownd of Tob. in all 2323l wth cask.
All wch are acknowledged by the deft, But the deft alleageth, That
the Bill for 1000l Tob. was for Land, Wch Land the sd Boreman plf
was contented to take againe, soe tht the deft payd unto him one hogs-
head of Tob. or Two Barrows, And the paymt of a hogshead of Tob,
to that end appearing by the Oath of Christopher Joanes. The Court
doth order that the plf doe abate the Bill for 1000l Tob. & tht the
deft pay the remaynder (viz) one thowsand three hundd twenty
three pownd Tob. in Cask, to the plf uppon demand.

Symon Ouerzee plf complayneth agst Mrs Jane Eltonhead for
deteyning certaine Cattle in her possesn & belonging to the sd Ouerzee
alleaging great dammage susteyned by him for want of the sd Cattle.
The deft acknowledgeth tht shee hath some such cattle in her possesn
It is therefore Ordered tht the deft immediately deliuer, or cause to
be deliuered unto the plf All such cattle, wch shee hath now in her
posses", or can, or may deliuer unto him, & wch are yett lyuing. And
as to those cattle wch were in her posses" & are dead; The dammage
therfore for the cattle wanting and their encrease, is to be Respited,
& Determined att the next Prou: Court.
