Whereas att the last Prouinciall Court held att S^t Maries p^o
Martij, his L^ps Attorney on the behalfe of the L^d Proprietary charged
M^r Symon Ouerzee w^th Theftboote & then produced his euidence to
proue the same; w^ch euidence was accepted by the whole board, &
the Cause by authority of that Court Respited, & ordered to be
determined att the next Prouinciall Court.
M^r Symon Ouerzee sayth, th^t hee neuer did contract w^th Daniel
Clocker, to any such intent, as is alleaged by M^r Attorney. And as to
those Bills he receaued, & those accounts allowed of the s^d Clockers,
were in satisfaction of his owne proper Debt, w^ch the s^d Cloker owed
him, & w^ch he demonstrated to the Board, by his Booke of Accompts,
att the last Court. And after long debate of the s^d Cause, M^r Ouerzee
craueth for a Jury to consider, & giue in euidence, whither or noe
hee may or ought to stand Charged w^th the ffact M^r Attorney bringeth
agst him, w^ch (through his intreaty) was graunted
Warr^t to the Sheriffe to impanel a Jury of 12 men forthw^th
Sheriffe Returnes his warr^t & Warned

Inditem^t Lett it be enquyred for the L^d Prop^e whither Symon
Ouerzee of S^t Johns, in the County of S^t Maries merch^t, Sometime
in the month of Nouemb^r last past did fraudulently contract w^th
Daniel Clocker for 3000^l Tob or thereabouts, on purpose to beguile
those iust Lawes instituted for the punishm^t of Malefacto" w^thin
this Prouince, Contrary to the peace of his s^d L^p his Rule, &
gouerm^t.
And the Jury Returning, brought in their Verdict, written on the
backside of the Writt, & deliuered by their fforeman.

The humble Petⁿ of John Pille Sheweth, That whereas M^r Walter
Hall standeth indebted to yo^r Pet^r in the Just summe of 977^l of
Sweet sented Tob & cask, yo^r Pet^r humbly craueth Order for satis-
faction, for the s^d Debt w^th forbearance & costs of suite &c.
