proper to shew our Indulgence to the Inhabitants. And also not to
prevent the Benefit of the Discoverys of Surplusage Lands to such
persons who may be Intituled thereto, by virtue of our sd Proclama-
tion: Therefore we Do Hereby Order & Direct, That where no prior
Discovery shall be made of any Surplusage Lands, and the Possessor
of such Lands shall not, either from circumstances of his case, or the
character of his person, be thought by you unworthy of our Favor, in
dispensing with our sd Proclamation, You shall permit him to Re-
survey such Surplusage Lands, & obtain a patent for the same as in
other cases directed by our sd proclamation.
Whereas Mr John Diggs hath made Application for a quantity
of Land on the Border & Frontiers of our Province in order to settle
sevl Familys or Inhabitants thereon, & Promote & carry on an Indian
Trade, & other Improvemts; And as we are willing to Incourage Set-
tlemts on the remote parts of our Province, We Hereby Direct, tht a
warrant may Issue to the sd John Diggs for the Quantity of 5000
Acres of Land, to be laid out where he shall think fitt on the remote
Borders & parts of our Province. And that, upon his giving good
security for the Caution-Mony, the Term of 5 years shall be Allow'd
for the payment thereof. And that the Quit-Rents for the same shall
be fix'd by you, according to our Instructions for Lands on the Bor-
ders or Frontiers. But our Farther Will is, that there shall be a
Provisoe in the patent, That if such Land shall not be settled by such
number of Familys or Inhabitants as you shall ascertain in the same
patent within 5 years fm the Date of the Patent, That then, such patent
shall be void, And that notwithstanding the same being so void, yet
the caution-mony so secured shall be paid

Instructions to Saml Ogle our Lieutenant Governor & Chancellor.
Whereas the Ordinary Bill will bring in Something, You must
keep an exact ace' of the Produce of it, as well as the Fines you were
formerly directed how to Apply; and the Amount of the whole must
be applied; to maintain a proper Force on the Borders of both Shores,
to protect his Majesty's Subjects in their just Rights.

Whereas by my last Instructions of the 26th of May, you were
order'd to pay to the general Rent-Roll Keepers 5 per Cent, it never
was my Intention to Allow them more than 5 pr ct on what came neat
into their hands.
