Gentlemen.
In your printed Votes of the 20th of last Month the following
Question and Resolution Appear (Viz) Whether by the Repealing
Law made 5th Day of September 1704 all Laws Antecedent to 26th of
April 1704 were not thereby Repealed Saving what were there Ex-
cepted & Saved or not ? Resolved in the Affirmative
If this House had not been well Satisfied in the unalterable Attach-
ment of your House to our Constitucon Modelled after that Excellent
one of our Mother Country, We might have been justly Alarmed with
the Consequences of such a resolution; for it is an Essential and un-
doubted Maxim in the English Constitution, And this House hath
Accordingly Resolved, that no Resolves or Votes of either or both
Houses can make any New Law or Abrogate or repeal any old one
Besides this Resolution so generally worded, as it stands in the
Prints, may have a Dangerous & unjustifiable Influence amongst the
Inconsiderate part of the Inhabitants, for through too great a Rely-
ance on the Authority and Judgment of that Resolve, they may be
misled into a Violation of Laws made before 26th April 1704: The
Printed Body of Laws prove severall Laws (beside those Excepted
in the Repealing Act made before that time) to be now in force; And
the Records may show Laws yet in force which are not Included in
that Printed Collection
These remarks this House thought themselves obliged to make
from a Sence of the joynt Duty they owe to the Government and
People.
