and to take with him or her one or two reputable Persons and go
under the Deck or into the Hold of such Ship or Vessell and View
his or her Tobacco Provided always that no Tobacco that is
stowed away out of View shall be unstowed to be so Examined
or Viewed as aforesaid And be it further Enacted that any Master
or other Person having the Charge or Command of any Ship or
Vessell who shall presume to hinder any such freighter and other
Person or Persons from going between the Decks or into the hold
for the Purposes aforesaid shall forfeit and pay fifty Pounds Current
Money One Moyety thereof to the Lord Proprietary the other
Moyety to the Freighter or other Person who will sue for the same
to be recovered by Action of Debt Bill Plaint or Information wherein
no Essoyn Protection or Wager of Law shall be allowed
And Be it Enacted by the Authority Advice and Consent afore-
said that the Surety or Suretys of any Master of a Ship or Vessell
within this Province shall be liable to make satisfaction according to
this Act for the Cropping Cutting abusing defacing or impairing any
Hogshead or Hogsheads of Tobacco as aforesaid and prosecuted
in any Court of Record within this Province that Can hold Plea
thereof and that Every Naval Officer within this Province shall on
Pain of five Pounds Current money to the uses aforesaid to be re-
covered as aforesaid Certifie under his hand and Seal a true Copy of
the Impost Bond of any Master of a Ship in Order to be put in suit
against such Master or his Surety or Suretys And that such Copy
shall be as sufficient Evidence in any Court of Record where such
Action shall be Commenced as the original Bond for which Copv
and Certificate the Naval Officer may have and receive the sum of
ten shillings Current money and no more and that the severall and
respective Naval Officers within this Province shall hang a fair
Copy of this Act in their respective Offices for the Perusal of Mas-
ters of Ships and Vessells the said Naval Officers to have and re-
ceive for the said Copy ten Shillings Current money to be allowed
them in the County Levy And be it further Enacted that every Per-
son or Persons paying or tendering to pay any packed Hogshead
of Tobacco whereon the full weight of the Empty Hogshead within
five Pounds is not Cut or marked upon the bulge of such Hogshead
and be thereof Convict in manner aforesaid he and they so Convict
as aforesaid shall forfeit for. Every such Hogshead or Hogsheads
not having the Weight set thereon as aforesaid the sum of forty
Shillings Current money the One half thereof to the Right Hon-
ourable the Lord Proprietary his Heirs and Successors toward the
defraying the Charge of the County where such Offence shall be
Committed the other half to the Informer or to him or them that
shall sue for the same to be recovered before a single Magistrate as
in Cases of small Debts This Act to continue for three years and to
the End of the next Session of Assembly which shall happen after
the said three years.
