The following Message by the Lower House of Assembly [See
page 327.]
Sent by Mr Dulany and Col Hooper to the Upper House.
A Bill Entituled an Act to adjurn the Courts of Assize nisi
prius and Goal Delivery Provincial Court and to Continue the
process and proceedings in Some of the County Courts, within this
Province and tc Enlarge the time for takeing out Executions Read
the first and second time by Especiall order passed, and Sent to the
Upper House by Col Ward, and Mr Denton.
A Bill Entituled an Act for Erecting a Town in Cecil County on
the North Side of Sassafras river at a place Known by the Name of
Peningtons Point &c. Read the Second time, passed and Sent to the
Upper House by Col Ward, and Mr Johnson.

Col King from the Committee of Accounts Delivers the following

report
By a Committee Appointed to Enquire into the Severall Allega-
tions Contained in the Petition of Charles Carroll Gentn
Your Committee Reports that they have Carefully Examined the
Several facts recited in the said petition and do find that there is a
Deed of Bargain and Sale, from Michl Curtis and Sarah his wife
May the Eighteenth Seventeen hundred and Eleven to Charles Car-
roll Esqr Deceased on the Back of which Deed it Appears that the
Private Examination of said Sarah was taken before Saml William-
son then a magistrate of St Marys County, on the Twenty sixth Day
of June following there also Appears a power of Attorney, Indorsed
to Wernell Hunt Esqr &c. to Acknowledge the said Deed which was
Accordingly Acknowledged on the said Twenty sixth Day of June
before William Holland Esqr Deceased Then a Provincial Magis-

trate your Committee also Reports, That there Does not Appear on
the said Deed, any proof, of the Execution of the said power of At-
torney but they Certify, that the said power of Attorney, was proved
on the Twenty Sixth Day of March, One Thousand Seven hundred
and thirty Six before Levin Gale Esqr by George Birches one of the
Subscribing witnesses thereto Your Committee further Reportes,
that it Appears to them by the affidavits of Danl Dulany Esqr Jus-
tinian Jordan Gentl and George Birches Physician that the facts
Contained in the above mentioned petition to us referred, are as
fully, and Strongly proved as anything of the Kind at this Distance
of time Can be And for the Information of the House, Your Com-
mittee have Inserted Coppies of the said Depositions which are as
follows, The Deposition of Danl Dulany Esqr Aged forty Eight
years.
This Deponant being duly sworn Deposeth and Saith That he
Remembreth, It was publickly reported Several Years Since (but
