the Libertys & Properties of the Good People of this Province
are Strengthened thereby.

Such free Declarations convince us that Your Lordships
would not have Disassented to that Act for the Better Sup-
porting the Magistrates in the Admrcon of Justice within this
Province had it not been out of a Tender Regard to the Preser-
vation of the Rights & Libertys of an English Subject A
Principle so Just & so Beneficent it fills us with Pleasure to
foresee that Justice & Clemency are like to become the Rule
of your Lordships Govermt.
But give us leave in most Humble maner to Represent that
the Particular p son mentioned in that act did never Apply
himself to the uper House upon that Occasion Altho he had
very Little Reason to Apprehend any Hardships there from

the Treatmt he mett withall a few Days [before] upon his Re-
fusall to Make such Reasonable Acknowledgment of his inde-
cent and Insolent Behaviour to our Governour in the Court of
Chancery & Elsewhere as was Required of him by Your Lpps
Letter to him for that Purpose. This gives a great Deal of
Reason to believe that the Subtill Insinuations and false Alle-
gations of that p son Prevailed upon those Eminent Gentlemen
of the Law to give their Opinions as they have been Trans-
mitted to us.
Wee Humbly Submitt to your Lordships Opinions that
Laws made agt Persons ex post facto if not unjust are at
Least Deemed Severe, but Such was the Case of that Partic-
ular Person that frequent Excuses Brought on Repeated
Transgressions and pardoning Instead of Humbling him made
him so much the more Insolent. Whereupon the Legislative
power seeing all Authority of Government Slighted and Con-
temned took in hand the Affair and made the Act afd as the
Only Effectuall Discouragement to such like Practices for the
future. But fforasmuch as Your Lordships have Been Pleased
to Disapprove of the manner of tacking any Particular Clause
to a Generall Bill We have so Just a Deference for your Lord-
ships Opinions in the Case that we have now proceeded to
remedy the Great Evil by two distinct Acts

Wee make no Question but the Advancement of Learning
within this your Province Shall be a very acceptable Thing to
you yet fforasmuch as the narrow Circumstances of an Infant
Country (All our Funds raised for that purpose falling short
of the End Designed) will not alone afford Sufficient En-
couragement thereto which Lays us under a necessity of Ad-
dressing your Lpps upon this Occasion for Altho the Condition
