Capt. Fendall & Mr Whittington

By the lower House of Assembly May the 3d 1718.
May it please yor Honours
We having taken in Considrs Your Message of Wednesday
last by Esqr Brooke & Esqr Hall in relacon to the Deduction
of Eight p Cent on the eighteen pence p hhd and on our
perusall of our Journall of May Assembly 1717, We find that
by a Message to yr Honours of the 8th of June last We made a

Clear State of that Case to which We shall only add that as
that Mony was raised Conditionally for his Lpps use if he was
pleased to accept thereof and if not for the defraying the
publick Charge so on his Lpps Pleasure of Acceptance Signi-
fyed We wholly resigned our Intrest therein for his Lpps use
without any Claim of Deduction thereout But must confess
if on his Lpps refusall to accept it the mony had been applyed
to the use of the publick the Navall Officers would have had a
right by law to deduct their Sallary of Eight p Cent agt us and
cannot alter our Opinions that as his Lpp accepted thereof he
took it as it was raised under the like Incumbrances We
should have had it in Case he had not accepted it But if any
Disputes be in this part it can in nowise affect us but lies
properly betwixt his Lpp and those Officers.

The House Adjourns till Monday Morning Eight of the
Clock.
Monday May the 5th 1718

The house meet according to Adjournment. Saturday's
proceedings are read.
