according to the Power vested in them by Law proceed to sus-
pend him from his practice in that Court, which if the said
Justices refuse to do I am humbly of opinion that your Ex-
cellency should shew your resentment of their folly or parti-
ality by dismissing them out of the Comission for the Adminis-
tration of Justice in that Court. Which I humbly submitt to
your Excys & the honbte Councill's better Judgement, & am
with all Duty & Respect your Excys most Obedient humble
Servt

I further Certify to your Excellency that by the Limitation

Moses Lecompt has no remedy either at comon Law or Equity

To his Excy The Govr & Councill

Present These

The Question being put whether the Justices of that Court
and Mr John Kirk the Attorny shall be sent for or not. Re-
solved Nemine Contradicente that they be sent for to answer
the Premisses.
Thereupon Sumons Issued to the Sheriff of that County to
Sumons Leivtt Colo Jacob Lookerman Capt Henry Ennalls,
Capt John Rider Capt Levin Hicks Capt John Keen, Capt
Henry Trippe & Mr Chas Nutter Justices of Dorchester
County Court & Mr John Kirk to appear before his Excellency
& Councill with all Convenient Speed not Exceeding Thursday
the 6th day of June next, And Delivered to the said Lecompt to
carry to the Sherriffe

The House Adjourns till
To morrow morning eight a Clock.

Informing him of his Indisposition and desiring to be Ex-
cused from his Attendance this Assembly. And also Inform-
ing him of a great delay of Justice in Somersett County Court
