Continuing his Obstinate and Contemptuous manner of Treat-
ing this Court,
It is ordered by his Excellency the Governour & Keeper of
the Greater Scale of this Province, That he the said Macne-
mara be Suspended from his practice in this Court untill he
shall make his due Submission.

But inasmuch as Maurice Birchfield Esqr his Majtys Sur-
veyor Generall of the Customes has upon the Score of the said
Mr Macnemara's being Imployed in Severall Causes in this
Court on behalf of the Crown Requested that the afd Macne-
mara might be permitted to finish the Business which He has
Imployed him in, It is ordered by his said Excellency the
Governour and Keeper of the great Scale of this Province in
respect of that Service, That Mr Macnemara be permitted so
to do.
On Mr Macnemara's motion for an Appeal from his Ex-
cellency's order for the said Macnemara's Suspension from
his Practice in this Court, to the King and Council in England,
It is by his Excellency granted so f arr as it will avail him ;
His Excellency alledging that the proper appeal from his
Order herein, should be before the Lord Proprietary.
A Copy of a Petition Preferred by Mr Macnemara to his
Excellency the Governour Viz.

To his Excellency John Hart Esqr Governour & Keeper of
the great Seal of Maryland.

The Humble Petition of Thos Macnemara Sheweth. That
your Petitioners Appeal from your Excellencys Order in
Chancery to Suspend him from his practicing in that Court is
Entered to his most Sacred Majesty King George in Councill
But forasmuch as his Majesty has been graciously pleased
to Restore his Lordship the Lord Proprietary to the Govern-
ment of this Province, your Petitioner humbly Conceives it
Proper to Appeal to his Lordship.
Your Petitioner therefore beseeches your Excellency that
the said Appeal may be granted & Entered accordingly,
And also humbly prays that the Particular Facts or In-

stances of his misBehaviour occasioning his Suspension may
be Expressed in your Excellencys Order or in such other
manner that he may have an Opportunity of makeing his
Defence, which he presumes he is Intituled to in Law and
Justice, or of making due Submission, Which he protests he
is Ready to do when he knows wherein he has Offended, or
shall be legally Convicted thereof.
And your Petitioner will pray
