An Act reviving a certain Act of Assembly of this Province,
Intituled, An Act for Limitation of Officers Fees, and for
Supplying some Defects therein; and also reviving another
Act of Assembly of this Province, Intituled, An Act explain-
ing some doubtful Expressions in the Act for Limitation of
Officers Fees.
Be it Enacted by the Queen's most Excellent Majesty, by
and with the Advice and Consent of Her Majesty's Gov-
ernor, Council, and Assembly of this Province, and the Au-
thority of the same, That the abovementioned Act, Intituled,
An Aci for the Limitation of Officers Fees, made at a Session
of Assembly, begun and held at the Port of Annapolis the
Fifth Day of December, Anno Dom' Seventeen hundred and
four; and also the abovementioned Act, Intituled, An Act
explaining some doubtful Expressions in the Act for Limita-
tion of Officers Fees, made at a Session of Assembly, begun
and held at the Town and Port of Annapolis the Twenty sixth
Day of March, Anno Dom' Seventeen hundred and Seven be
and are hereby Revived and Continued in full Force and
Strength, from and after this present Session of Assembly,
for and during Three Years, and to the End of the next Ses-
sion of Assembly that shall first happen after the Three Years.
And whereas the Imprisonment Fee of Twenty Pounds of
Tobacco, limited for Sheriffs in the afore recited Act for Limi-
tation of Officers Fees, is found to be extravagant, and a great
Oppression to the Poor of this Province; Be it further Enacted
by the Authority aforesaid, by and with the Advice and Con-
sent aforesaid, That the Sheriffs of the several and respective
Counties of this Province shall receive, as a Fee for keeping
a Prisoner in Custody, and finding him Victuals, the Sum of
Twenty Pounds of Tobacco per Day, during the First Month's
Imprisonment, and Ten Pounds of Tobacco, and no more, for
every Days Imprisonment and Victualing after the End of the
First Month's Imprisonment; Anything in the recited Acts, or
any Law, Usage, or Custom to the contrary notwithstanding.
And whereas also there have been several Fees allowed to
the Officers by Her Majesty's Governor and Council for sun-
dry Services not provided for by the before recited Acts; Be
it further Enacted by the Authority, Advice and Consent
aforesaid, That it shall and may be lawful for the several
Sheriffs of this Province, to take the Fees hereafter mentioned
for the Services following (Viz.)
For Serving a Writ of Possession, One hundred and fifty
Pounds of Tobacco.
For Serving an Ejectment, One hundred Pounds of Tobacco.
