Baskett

Chest, Box, or Case, on all Tobacco that shall be exported
out of this Province, by Land or by Water, be raised, levied,
and paid to Her Majesty, towards the Defraying the Publick
Charge of this Province, by all Masters of Ships, and other
Vessels trading into this Province, in Money Sterling of Great
Britain, or by good and sufficient Bills of Exchange to be
collected by the Naval Officers of the Port or District, where
such Ship or Vessel shall clear; and the said Naval Officers
are directed and required by this Act to receive the same in
Money Sterling of Great Britain, or by good and sufficient
Bills of Exchange accordingly: And the said Naval Officers
shall account and pay for the said Imposition of Three Pence
per Hogshead, and the Three Pence for every Five hundred
Pounds of Tobacco, contained as above, in Money Sterling,
as aforesaid, or such Bills of Exchange, to the Treasurers of
this Province, who are hereby required to render an Account
thereof, and pay the same in Money Sterling, as aforesaid, or
such Bills of Exchange, to the General Assembly; Any Law,
Statute, or Usage to the contrary notwithstanding.
And be it further Enacted by the Authority aforesaid, by
and with the Advice and Consent aforesaid, That the said
Imposition of Three Pence per Hogshead, and Three Pence
for every Five Hundred Pounds of Tobacco, contained as
abovesaid, shall be appropriated by the General Assembly of
this Province towards the paying the Publick Charge thereof,
and to no other Use whatsoever.
And be it further Enacted and Declared by the Authority
aforesaid, by and with the Advice and Consent aforesaid,
That if any Tobacco should by any Casual Means be lost
after the Imposition paid, that then and in all such Cases the
Owner or Freighter of all such Tobacco shall have free
Liberty to freight and ship off the like Quantity again, without
paying the said Imposition.
And be it further Enacted by the Authority aforesaid, by
and with the Advice and Consent aforesaid, That One Act of
Assembly, begun and held at the Town and Port of Annapolis
the Fifth Day of September, Anno Dom' One thousand
seven hundred and four, Intituled, An Act for laying an Impo-
sition of Three Pence per Hogshead on Tobacco, for Defray-
ing the Publick Charge of this Province, and every Article,
Clause, Matter, and Thing therein contained, shall be, and is
hereby utterly Repealed and made Void: And this present
Act to be and endure in full Force and Strength for the Term
of Three Years, and to the End of the next Session of Assem-
bly after the Three Years.
