On Consideration of this Bill this Board is of opinion that
the latter part obliging the Creditors to take Goods at such
Value that none will give, Shews so great Injustice to Credi-
tors and will necessarily discourage Trade that we cannot
agree to it.
The Supplementary Bill to the Act for better Administration
of Justice in Probat of Wills &c being read was ordered to be
Endorsed
The Original Act for administration of Justice in Probat of
Wills, will upon the Arrival of a Governour in chief want
Revising. And for that there are some objections against
this Bill now proposed we desire that the Consideration
thereof may be referred till the Arrival of a Capt General
The Bill permitting the Inhabitants of this Province to Sue
out Writts and confess Judgments in their proper Persons was
Ordered to be Endorsed

We are of opinion if this Bill should pass It would introduce
a great deal of Confusion in the Courts of Common Law.
But as to the Liberty of Confessing Judgements in their
proper persons after Baile given 'tis so reasonable we are told
'tis always so practised in the Provincial and most of the
County Courts But if any of the County Courts refuse to
admitt thereof, This opinion of our Board with the Concur-
rence of your House thereto will be a means to rectify it and
therefore we think the Bill needless
