the highest that ever we find allowed even when the whole
body has been revised and which we Cannot in reason advance
As to the last Session Laws we have examined the Laws &
find the Proportion is sufficient and why your Honours pro-
pose 1000 lb Tobo because of Precedents and not as the Law
directs us then we should allow but one thousd pounds of
Tobo for this Body which would be unreasonable but your
Honours know it is the true Intent of the Law that we and
you look to and not critical Exceptions which if we would
make use of we might scruple to allow any thing for last Ses-
sions Laws because they were not allowed for then as the
Law directs but we mean nothing but what is honest and fair
and desire to be so understood and used
To the private bills we mean the Persons to be answerable
for the same as the publick is for the publick ones
And altho we shall not dispute the weight of Business that
lyes upon any Clerk believing Every one has Enough We
Desire to be Excused from increasing any ffees on private
bills at this Time more than what has been used before and
we do not find your Clerk (tho we have a respect for him)
ever allowed any ffees on private bills and hope you will not
press that matter any further but joyne with us in hearty En-
deavours to dispatch the weighty matters in Hand

Mr Frisby and two other members bring from the House
the following Message Viz.

By the House of Delegates

September the 28th. 1704

We have Considered your Honours message by Col Ham-
mond and are Sorry your Honours will not join in the Address
Since you are pleased to say you think it necessary to prevent
an imminent Danger and we cannot believe our Agent has so
little value of us as to let it lye Dormant by him when we gave
him the assurance of paying what he disburses for us in laying
it before her Majesty which we always proposed to do

Your Honours are pleased to say you have addressed her
Majesty on that subject and we doubt not but your Honours
expect it to take Effect and yet we have not heard of any sum
of Mony raised or person appointed to go with it, and we
hope this may go also if your honours please. We again
humbly offer ourselves in the Addresses and we hope we shall
be discharged of any misfortune that may attend the non
addressing since we are ready to Joyne in it
