as followeth (That is say) Beginning at Turkey point on the
North side of Elk River aforesaid and running with the said
river to Smiths Mill at the head thereof then east to the Ex-
terior bounds of this Province to Susquehanna River thence
with the east side of the said River and the bay of Chesepeak
to the first Beginning shall be and is by this Act Constituted
Erected and made into a parish to be called by the name of
North Elk Parish Seperated and Divided as aforesaid from the
Parish Already made in the said County & shall be and is
hereby adjudged deemed and Taken to be a Separate and
distinct parish and shall have hold and Enjoy all previlledges
and Advantages that are held and Enjoyed by other Parishes
in this Province.

An Act for Vesting and Settleing Certain Lands In John Whit-
tington and his Heires Late the Estate and Inheritance of a
Certain Daniell Toaes for and towards Sattisfication and pay-
ment of a debt Due from the said Toaes and paid by the sd
Whittington.

Whereas John Whittington of Kent County Gent: by his
petition to this Present Generall Assembly hath sett forth that
a Certain Daniell Toaes late of the said County Deceased being
in his Life time Indebted to a certaine Richard Swetnam Late
of Talbott County Deceased in the sume of thirty five Thous-
and pounds of Tobacco & being Willing & Desirous to have
the same Satisfied and payed by his last will and Testament
in writing did leave severall tracts of Land to be sold for the
payment of his Debts and of his said will did Constitute and
appoint his son Daniell Toaes the son & Executor suffered
himself to be sued for the said Debt Due to the said Swetnam
and being taken in Execution for the same did prevail wth the
said John Whittington and a Certain Michaell Miller since
Deceased to become security for payment of the said Debt &
