the Petrs tho they so stile themselves rather seeme to challenge
than petition for a Toleration & Freedome & unhandsomely
Charge the Generall Assembly with infringing the same which
they cannot have the least reason to offer seing at the time of
making the Act they had not even the slightest Assurance of
such freedom or Tolleration All which is of the Same piece
with the latter part of the Petition seeming to Insinuate as if
her Majesty would forgett the minutest thing for the ease &
advantage of her Subjects Neither has this board any reason
to be Satisfyed with the Petition" Construction of the houses
Intention which they say was that untill her Majestys Pleasure
should be knowne that they might not be disturb'd in the In-
tervalls of Assemblys. But we hope we have a better right
and with better reason to Judge it was quite Contrary thereto

for otherwise to what end was the penall Act made or the
Suspending one limitted to Eighteen months a certain time
prefix'd
The aforegoing Remarkes on the said Peticon together with
the proposd bill for the Tolleration of the Papists was sent to
the house by Coll Hamond & Coll Jenkins & then
The Board adjourn'd to Munday morning

Mr Cheseldyne & Mr Coursey
Read the Petition of Mr Samuel Chew & Mr Nehemiah
Birkheard praying that a bill may be brought in to enable
them to sell Abraham Naylors Estate & dispose the same to
the uses in his will mencon'd.
The said Petition being read & the Board Considering the
Will is to a pious use the Relief of the Poor and that Abraham
Naylor has no heir are willing that a bill may be brought in to
Confirme the Will & recomend the Petition to the house of
Delegates.
Which recomendation was sent to the house by Col Hamond
& Coll Jenkins.
The following Message ordered to be drawn up Viz.

By the Councill in Assembly &c.

Whereas in a late Session there was an order made that the
Powder house should be remov'd within the Towne where the
Governour thought fitt But for as much as the Undertakers
aske tenn pounds therefor and will runn no Risq in Case it
