And is again brought from the House with the Salvo in-
serted by Col Barton.
Mr Thomas Frisby Mr Pearce Mr Dare bring up the other
Bills this day sent down to the House
Then came the members of the Council appointed to join
those of the House upon the Conference and made report of
what had been transacted there which was not by the Board
agreed conceiving that the Conferees had mistaken the Sub-
ject matter of the Conference proposed therefore ordered the
following Message be sent to the House viz.

By the Council in Assembly Sepr 13. 1704
The report of the Committee appointed the 11th Instt touch-
ing the Design forming against the Constitution of the
Government has been read at this Board and it is Conceived
that the Conferees have mistaken the Subject matter of the
Conference for want of having the same in Writing which by
the Houses message to this Board was to Consider the many
Evils that would thereby redound both to her Majesties Interest
and Welfare of this Province therefore propose that full In-
structions be given the said Conferees and that they meet
again on that Subject by eight of the Clock tomorrow morning

Mr Tyler and Mr Magruder bring from the House the fol-
lowing message viz.

By the House of Delegates
Resolved by this House that it is necessary for the Safety of
this Province that the Secretary who has the keeping of the
Records before his Entering into his office be obliged and
bound to preserve the Books in which the Records are con-
tained in as good Condition as he receives them at his own
Charge and they be Visitted at every meeting of Assembly
and that if any Defect be in keeping the said Records to be
repaid and made good out of his own Estate and that the pre-
sent Secretary give security as above to which the Councill's
Concurrence is prayed
