44 Assembly Proceedings, Sept. 5-Oct. 3, 1704.

Came Mr Greenfield and Lieut Col Maxwell and humbly
acquaint his Excy that the House do comply with the said
message
Col Smith and four other members bring from the House
the following Message

By the house of Dels Sepr the nth. 1704

This House returns your Excy their humble thanks for the
Intimation you were pleased to give of a design forming
against our Constitution and your Explaining the same by a
message this day sent by the honble Robert Smith and John
Hammond Esqr and pray that you will always preserve the
same tender Regard of us which we will endeavour to deserve
Signed p order W Taylard Cl ho Del.

The Board adjourns for two Hours.

His Excy being informed that two Popish Priests to wit
William Hunter and Robert Brooke pursuant to the summons
from this Board attend to the Complaint against them made
and that Mr Charles Carrol a Lawyer accompanied them,
asks the Board if the said Priests ought to have their Council
with them who unanimously agree and say they should not

His Excy Queries whether upon the Pretence of any Cus-
tom of Toleration from the first Settlemt of this Province the
Actions of these Priests can pretend any justification who
say not

The said Mr William Hunter and Mr Robert Brooke ap-
peared and are told on what occasion they were called before
his Excy Mr William Hunter gives his Excy many thanks for
the opportunity of appearing before his Excy and says he is
very sorry for any annoyance in his Conduct as to his conse-
crating the Chappel he did not Consecrate it for that is an
Episcopal Function and that no body was present but himself
in his common Priests vestments and that neither under his
Excys Eye nor in his presence but if any such thing was done
it was above fourteen months ago, and long before his Excys
