         Appendix to Council Proceedings, 1696—1729.  561

   

    done, and preparacon made for the Tryal, but in few days the B. M.

    Governr orders the Discharge of the Briganteen. By this yoT Vol. 25

    Excy may guess what Justice his Matt may expect from tht

    Governour or Governmt, which is all &c.

     The above is a copy of what was cont by Col. Quarrey him

    self att end of a longe narrative concerning the illegal Trade,

    &c. which amongst a great many other papers were sent to

    the Lords for Plantacons & the Secretary of State, the Lords

    of the Treasury and the Commissioners of the customes by

                [signed:] Fr: Nicholson

   

     Memorandum to inquire of Mr Savage at the Custom House,

    the Secretays Office, the Plantacion Office, and the Treasury

    for Col. Quarrys paper about illegal Trade, &c.

   

     [Endorsed:] Part of Coll. Quarrys letter to the Governor

    Pensilvania Privateers.

           April the 1697 From my Plantation

                   near Philadelphia

    Sr

     Pardon this Boldness I have pursuant to a Proclamation In

    formed Governr Markham of 3 or four Servts that were in the

    Ship Fancy that was run away with from Spaine that belong

    to England & that committed the Piracy as is mentioned by

    the said Proclamation as by their owne Confession & by all

    circumstances as by having Arabian plate & money & by their

    coming from Providence to Carolina & from thence hither

    but hee would not take any notice of it saying tht he never

    saw the Proclamation I offered to shew it him wch he refused

    saying that hee had nothing to doe wth it since it was not direct

    ed to him, I being a Magistrate thought it my duty notwit

    standing to apprehend three persons & likewise informed the

    rest of the Magistrates but they being Quakers and seeing

    the Governrs dislike to it did not care to meddle with it how

    ever I charged thm with & prayed their assistance after I had

    apprehended two of them & desired they might bee secured

    according to law but notwithstanding bailed them whose bale is

    one bound for another and others tht was guilty of the same fact

    though not in the same ship wch I declared agst I not being a

    Quaker and the Governrs dislike to the Proceedings was

    abused for doeing my duty I desire that yT Excy will be pleased

    to recommend it home to the Lords Justices these persons

    names are as they goe by here & as I suppose went by aboard
