Governor and Council Ordered that the honble Colo Young and Benja Tasker Esqr view the said work and if their Honours are of Opinion that the work deserves so much that then his Honour Colo Young is hereby Empowred to pay the same or so much thereof as shall be Adjudged reasonable out of the Money arising from the 3d p hhd sterling for Arms &c Provided nothing appear ing upon the Journals of this honble Board (Great part of which are not immediately to be found) to the Contrary The humble Petition or Representation of John Moale and Daniel Russell on behalf of Jonathan Forward of London Merchant exhibjtted here to the Board and is as followeth vizt
To the Honourable Charles Calvert Esqr Lieutenant Gov- p. 118 ernor of the Province of Maryland and to his Lordships honble Council
The humble Representation of the Factors of Jonathan Forward
Humbly Sheweth That your humble Petitioners beg Leave to inform your Honours that whereas our Imployer Mr Ionathan Forward of London Merchant having Contracted with the Government of England for the Transportation of Convicted Persons and Felons to this or any other of his Majestys Plantations in America and there to Land them as p his Bond Given to the Government to that intent and also to make Sale of them to his most Advantage having by said Order of transfer a right and Property in their Service here for such Respective term of years as p an Act of Parliament made in the 4th year of his now Majestys reign may more at large appear, Pursuant to the aforesaid Contract and Authority by Act of Parliament the said Jonathan Forward sending a Certain Number of them in two Ships which being arrived in this Province at this Port of Annapolis Assigned to your Petitioners and others the said Forwards Factors here were by said Factors according to Law reported to the Naval Officer of said Port which fully Accom plishes the Bond aforesaid Given by said Forward to that purpose Your petitioners humbly beg Leave to inform your Honours that we the said Forwards Agents are in Effect denied the Benefit of the property proposed by the said Act being p. 119 greatly hindered by the Corporation of this City of Annapolis by virtue of a Law as some have said of their own making for instead of having the Liberty to dispose of them to such
