C. P. to Accept the Same; then You Shall Appoint the third per son of our Councill Actually Resideing within the Province to Execute the said Office as afd And upon his Absence or Refusall, the Senior of our Councill for the time being. 3: Whereas by Act of Assembly made in the 2d Year of our Dominion, Intituled An Act Ascertaining the Gauge & Tare of Tobbo hhds &ca there is to be raised to the Lord Pro prietarie for the Support of Governmt fifteen pence p hogs- head for Every hhd Exported &c. whereof 12 pence p hhd is to be Applyed towards the maintaining the Station & Dignity of his Lordships Lieutenant Governour Actually Inhabiting & Resideing within the Province, and such other uses as his Lordship shou'd Judge Proper; And in Case of the Death or Removall of such Lieutenant Governour from his Govern ment, the One half of the said 12 pence applyed to the Sup port of Government as afd that shall arise in such Vacancy shall be Applyed to the Maintainance and Support of such Person of his Lordships Councill as his Lordship by his In structions to his Leiutenant Governour or otherwise shall Appoint to Preside, And to such other uses as his Lordship thinks meet, And the other half of the said Twelve pence towards the building a House for his Lordships Lieutenant Governour to live in, as by the said Act is at Large sett forth; Our Will now is that Dureing the Absence of the said John Hart our Lieutenant Governour the said 12 Pence ariseing as afd for the Support of our Government shall be Applyed in the same Manner and to the same uses as by the said Act is Provided in Case of the Death or Actuall Removall of our Lieutenant Governour. 4: And Whereas by Act of Assembly three pence per hogshead is given you the said John Hart so long as you shall Continue Governour in and Over the said Province and no longer, You may if you are Desirous thereof, Endeavour to prevail with the Assembly to Continue the said Duty of three Pence per hogshead to be Applyed to your own Use, dureing your Absence out of the Province, Untill Such time as we shall think fitt to Superseed your Comission. Provided you bring such Act so made, Over with you for our Assent or Dissent thereto, If it Can be Conveniently Enacted before Your Departure. 5: You shall Recomend to the Assembly that we think it Convenient and Necessary that the Duty of three Pence p Tonn upon the Burthen of Ships and Vessells Tradeing into the Province, which by Act of Assembly has been usually paid unto the Governour for the Time being, be Continued & Applyed to the better Support and Dignity of such person of our Councill, who is Entrusted with the Administration of the
